Terms and Conditions

Welcome to Fittalty! These Terms and Conditions ("Terms") govern your use of the Fittalty fitness platform (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions, as well as our Privacy Policy available at https://www.fittality.app/privacy.

Definitions

  • App: Refers to the Fittalty mobile application you download from the App Store.
  • Service: All features, content, and functionality provided through the App, including workout plans, analytics, and chatbot interactions.
  • Content: All text, images, data, and other materials available in the App (including user-generated selections for AI workout generation).
  • You/User: Any natural person who downloads, accesses, or uses the App.

1. Overview

Fittalty is a personalized fitness platform designed to help users set goals, track progress, and follow structured workout programs. Key features include:

  • Pre-built training programs and custom workout creation.
  • Workout logging and performance tracking.
  • Integration with on-device Apple Health Kit for fitness data.
  • PRO features including advanced analytics, AI Program Generator, and an OpenAI-powered chatbot.

2. User Accounts

  • Registration: Users must create an account via Supabase Auth or Sign in with Apple.
  • Accuracy: You agree to provide accurate, current, and complete information.
  • Security: Keep your credentials confidential; you are responsible for all activity under your account.
  • Age: The App is intended for users 18 and older. We do not knowingly enforce age verification and cannot guarantee compliance.

3. Subscription & Billing

PRO features are offered via in‑app subscriptions processed through Apple's in‑app purchase system (IAP) via RevenueCat.

Pricing & Trials

  • Weekly PRO: US$1.99
  • Monthly PRO: US$5.99
  • 3‑Month PRO: US$19.99
  • Annual PRO: US$49.99
  • Free Trial (if offered):
    • Trial duration (e.g., 7 days) and applicable terms will be clearly presented in the App prior to enrolling.
    • To avoid charges, you must cancel your trial through your Apple ID account settings at least 24 hours before the trial end date.
  • Price Changes: Subscription pricing may vary based on App Store regional pricing and may be adjusted by Apple. Any price changes will be communicated in the App Store prior to renewal.

Payment, Renewal & Cancellation

  • Payment Processing: All payments and renewals are handled by Apple's IAP system via RevenueCat.
  • Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours before the end of the current period.
  • How to Cancel: You can manage or cancel your subscription at any time through your Apple ID account settings in the App Store. Access remains active until the end of the current paid period.

Refunds

All sales are final. Refunds are subject to Apple's refund policies and any applicable law.

App Store Terms

Your subscription is subject to Apple's App Store Terms of Service. You acknowledge and agree that Apple is not responsible for the App's content, privacy practices, or fulfillment of any subscription. Any claims, losses, liabilities, or damages arising out of or relating to the App or these Terms must be directed to Fittalty, and not to Apple.

4. OpenAI Chatbot

PRO users may interact with an OpenAI-powered chatbot within the App. Before using this feature, you must provide explicit consent to share any personal or health-related information with the AI service. The chatbot workflow requires you to complete tailored selection steps; no free-text input is stored beyond your current session.

  • Data Processing: User inputs and selections are transmitted to OpenAI's Responses API for the sole purpose of generating chat replies or custom workout programs. Fittalty does not store chat transcripts beyond the active session; any logs are retained temporarily for debugging and quality improvements for up to 30 days.
  • Third-Party Terms: Use of the chatbot is subject to OpenAI's Terms of Use and Privacy Policy (OpenAI Privacy Policy,OpenAI Terms of Use).
  • App Tracking Transparency: If any identifiers (e.g., IDFA) are used for analytics or personalization in connection with the chatbot, we will request your permission under Apple's App Tracking Transparency framework.
  • Consent Withdrawal: You can disable the chatbot feature or revoke consent for data sharing at any time in Settings > PRO Features.

5. AI Workout Program Generator

PRO users can generate a custom AI-crafted workout program using our program generator feature by interacting with the OpenAI Responses API. You choose whether to share your personal information before proceeding. The generator is a guided, multi-step process with only multi-select options—no free-text input:

  1. Share Personal Info: Opt to include or exclude your personal data.
  2. Goal: Select your primary fitness goal (e.g., strength, endurance, weight loss).
  3. Experience: Select your experience level (e.g., beginner, intermediate, advanced).
  4. Plan Duration & Schedule: Choose the length of your plan and workout days per week.
  5. Equipment: Select available equipment.
  6. Workout Preferences: Choose workout types you enjoy (e.g., HIIT, yoga, weightlifting).
  7. Review Selections: Overview of all selected options prior to submission.
  • Data Handling: Your selections are sent to the OpenAI Responses API only for generating the program. Fittalty does not store these selections beyond the current session.
  • Legal Basis: Data processing based on your consent when initiating the AI generator feature.
  • OpenAI Terms: Use of this feature is subject to OpenAI's Terms of Use and Privacy Policy.

6. Acceptable Use & Conduct

  • Prohibited Activities: Fraud, abuse, harassment, or any behavior violating these Terms or applicable laws.
  • Enforcement: We may suspend or terminate your account for violations of these Terms. Such suspension or termination will not entitle you to any refund or compensation.
  • Consequences: Account suspension or termination will revoke your access to the App and its services immediately.

7. Disclaimers & Limitation of Liability

  • No Medical Advice: The App provides algorithm-generated fitness suggestions and analytics for informational purposes only. It is not a substitute for professional medical advice or devices.
  • Force Majeure: Fittalty is not liable for service interruptions due to events beyond our reasonable control (e.g., acts of nature, network failures).
  • Liability Cap: Our total liability is limited to the amount you paid in the last subscription period. We are not liable for indirect, incidental, or consequential damages.

8. Intellectual Property

All App content, features, and technology are owned by Fittalty or its licensors. No user-generated content is collected or shared.

9. Dispute Resolution

  • Informal Resolution: Please contact us at info@fittality.app first to resolve any issue.
  • Governing Law: These Terms are governed by Icelandic law. Disputes will be subject to the exclusive jurisdiction of the courts in Reykjavík, Iceland.

10. Changes to These Terms

We may update these Terms periodically. Changes will be posted here with a new "Last Updated" date. Significant updates will be communicated via in-app notifications.

Version History: A version history of these Terms is available at https://www.fittality.app/terms/archive. If no historical versions exist yet, the link may return a 404.
